To transfer an employee from a third-party employer to Remote People' new in-house entity in Chile, the employee must first resign from their current employment contract. In Chile, this process must be done digitally and officially through the Labor Directorate's portal, known as Mi DT.
This article outlines the step-by-step process and key responsibilities involved.
Step-by-Step Process
1. Employee Initiates Digital Resignation
The employee must log into the Mi DT portal using their RUN and Clave Única credentials.
They must select the Renuncia Voluntaria Digital option and complete the resignation form with employer details.
2. Ratification Before the Labor Directorate
The resignation must be ratified before the Labor Directorate, which acts as a Notary Public.
During this step, the Labor Inspector verifies the employee's identity and records the resignation date.
3. Download the Official Resignation Form
After ratification, the employee can download the Ficha Digital (official resignation form) from the portal.
This document is also sent to the employee via email within 48 hours.
4. Employee Delivers Copy to Remote People
The employee must submit a copy of the ratified resignation form to Remote People.
This step is essential: Remote People is only considered officially notified once the form is received.
5. Remote People Acknowledges Resignation
Upon receiving the resignation form, Remote People can formally acknowledge the resignation and proceed with the offboarding.
6. Offboarding Process Begins
Remote People initiates the standard offboarding process:
Final payroll
Closure of benefits
Return of equipment (if applicable)
7. Onboarding to Remote People' In-House Entity
Once offboarding is complete, the employee can be onboarded into Remote People' new entity as a direct hire.
Important Notes
The resignation is not legally valid until it is ratified and delivered to the employer.
The process is the employee's responsibility and must be completed through their own Mi DT portal.
Remote People cannot initiate or complete this process on behalf of the employee.
