What are the Paid and Unpaid Leaves in Vietnam?

In Vietnam, employees are entitled to various forms of leave, each with specific conditions and benefits. Here’s an overview of the different types of paid and unpaid leave available:

Paid Leave

Maternity/Pregnancy Leave

  • Duration: 6 months (including 2 months before the expected birth date)

  • Benefits: Employees on maternity leave receive social security benefits, which help support them during this important period.

Paternity Leave

  • Duration: 5 to 14 days

  • Benefits: This leave is available for the second parent (often the father) and includes social security benefits to support the family during the early days of a new child’s arrival.- Required Documents: Male employees must provide the following documents to claim paternity leave benefits:

    • Notification of Birth (Giấy chứng sinh) or Birth Certificate (Giấy khai sinh)

    • Hospital Discharge Paper (Giấy ra viện)

    • Citizen Identification Cards of both parents (front and back)

  • Documentation Notes: If a Birth Certificate is not yet available, a Notification of Birth can be submitted as an alternative. However, if the father’s name is not listed on the Notification of Birth, a Marriage Certificate may be required to establish the parental relationship. Ensure all submissions are clear, legible, and meet the requirements of the Social Insurance Authority. In some cases, notarized hard-copy documents may be requested.

Marriage Leave

  • Duration: 3 days

  • Benefits: Employees are granted time off to celebrate their marriage, ensuring they have adequate time to manage wedding-related activities.

Marriage of Children Leave

  • Duration: 1 day

  • Benefits: Employees can take a day off to attend the marriage of their children, acknowledging the significance of this family event.

Bereavement Leave

  • Duration: 3 days

  • Benefits: In the event of the death an immediate family relative, employees are entitled to 3 days fully paid bereavement leave to grieve and attend to family matters. Immediate family is defined as biological or adoptive parent, spouse's parent (in-law), spouse, biological or adopted child. Note: 1 day of unpaid leave is granted when an extended family member dies: grandparent, biological sibling.

Unpaid Leave

  • Condition: Unpaid leave may be granted based on the employer's approval.

  • Benefits: While unpaid leave does not provide salary compensation, it allows employees to take necessary time off for personal reasons or special circumstances, subject to their employer’s consent.

These leave policies are designed to support employees during significant life events and personal needs while balancing the operational requirements of businesses.
