What are the sick leave rules for employees in Peru?

Employees in Peru are entitled to sick leave, subject to specific requirements and procedures under local labor and social security law.

Medical Certification

Employees must submit a Temporary Work Disability Certificate (CITT) issued by ESSALUD (the national social health insurance) within 2 business days from the start of the sick leave. This document formally certifies the employee’s medical incapacity.

Eligibility for ESSALUD Benefits

To qualify for medical leave benefits paid by ESSALUD, the employee must have contributed to ESSALUD for either:

  • At least 3 consecutive months, or

  • At least 4 non-consecutive months.

Sick Leave Payments

  • First 20 days of sick leave are paid directly by the employer at the employee’s regular salary.

  • From day 21 up to a maximum of 340 days (approximately 11 months and 10 days), the sick leave payment is covered by ESSALUD.
