In Poland, when a public holiday falls on a Saturday, employees working a Monday to Friday schedule are entitled to a compensatory day off. This article explains how public holidays such as May 3rd (Constitution Day), November 1st (All Saints’ Day), and August 15th (Assumption of the Blessed Virgin Mary Day) are treated when they fall on a Saturday.
Public Holidays and Compensatory Time Off
According to Polish Labor Law (Article 130 paragraph 2), employees are entitled to a compensatory day off when a public holiday falls on a Saturday. This day off must be granted within the same settlement period, typically within the same month. Remote People encourages employees to take this compensatory day off on the following Monday, or another workday within the same month. If employees wish to take the day off on a different date, they must request approval from their direct line manager.
May 3rd – Constitution Day
When May 3rd (Constitution Day) falls on a Saturday, employees working Monday to Friday are entitled to a compensatory day off. Remote People encourages taking the following Monday where operationally feasible. If an alternative day is needed, it must be taken within the same calendar month and approval should be sought from the direct line manager.
November 1st – All Saints’ Day
When All Saints’ Day (November 1st) falls on a Saturday, employees will receive a compensatory day off. Remote People encourages taking the following Monday or another day within the same calendar month. Any exceptions should be discussed with the direct line manager.
August 15th – Assumption of the Blessed Virgin Mary Day
When Assumption of the Blessed Virgin Mary Day (August 15th) falls on a Saturday, employees in Poland working a Monday to Friday schedule are entitled to a day off in lieu within the same calendar month, in accordance with Polish labor law (Article 130 paragraph 2).
What You Need to Know
The day off in lieu must be taken within the same calendar month and cannot be carried over.
Remote People recommends taking the preceding Friday (the working day before August 15th), where operationally feasible.
If this date is not suitable, employees may coordinate an alternative date within the same month with their line manager.
No leave request or platform submission is required for this day off.
Please take this into account when planning employee schedules and ensuring appropriate team coverage during the relevant month.
Payroll Impact
Please note that the compensatory day off does not impact payroll. Employees will be paid as usual, and the compensatory day will be accounted for in the same settlement period. Remote People will ensure that payroll remains consistent and compliant with Polish labor laws.
What Remote People Will Do
As your Employer of Record (EOR), Remote People will ensure that all compensatory days off are properly communicated. We will notify employees and clients accordingly. Please note that the Remote People Platform will not show the compensatory day off on the Leave Overview.
