Under the Termination of Employment Law (1967), an employer is prohibited from terminating an employee who is absent due to incapacity for work for a period of up to 12 months.
This protection begins from the first day of the employee's absence and continues for a period that equals the total duration of the absence plus an additional one-quarter (¼) of that absence period. For example, if an employee is absent for 8 months, the prohibition on termination extends for 10 months (8 months + 2 months).
During this protected period, the employer cannot issue notice of termination based on the employee's incapacity. Remote People strictly follows these legal protections to ensure employees' rights are respected.
